What is a property owner’s duty of care?
The owner or other party controlling the area must act with reasonable care in the circumstances. That may mean inspecting, fixing, protecting against, or warning of a hazard. The duty is assessed in light of foreseeable harm and practical precautions. It does not make the controller an insurer against every injury on the property.
